In the wake of the Supreme Court ruling making the law’s Medicaid expansion optional, some state officials say they will opt out because they cannot afford even 10 percent of the program’s costs. Others, though, are moving forward.

Kaiser Health News: States Balk At Expanding Medicaid
Hours after the Supreme Court upheld President Barack Obama’s health law on Thursday, but made its Medicaid expansion optional, senior White House officials were asked by a reporter how they would entice states to participate. They laughed. It seemed almost inconceivable to them that states would opt out (Galewitz, 7/2).

The Wall Street Journal: Some States Balk At Medicaid Expansion
Opposition to expanding Medicaid under the health-care overhaul is hardening in some Republican-led states, as Gov. Rick Scott of Florida said over the weekend that he will opt out. His decision puts the former hospital executive at odds with state hospitals. Another half dozen Republican-led states—Iowa, Louisiana, Mississippi, South Carolina, Texas and Wisconsin—say they, too, may opt out of widening eligibility for the federal-state insurance program for the poor starting in 2014 (Radnofsky, Mathews and McWhirter, 7/2).

The New York Times: Republican Governor Of Florida Says State Won’t Expand Medicaid
In another sign of resistance to President Obama’s health care overhaul, Gov. Rick Scott of Florida, a Republican, said Monday that his state would not expand its Medicaid program (Pear, 7/2).

Several governors of states, notably in Florida, have already come out and said they will take advantage of the Supreme Court’s health care decision not to offer additional Medicaid coverage. That’s important because the changes to Medicaid are supposed to account for roughly half of the 30 million people who are supposed to get health-care coverage. But Peter Orszag, vice chairman of global banking at Citigroup and President Obama’s former director of the Office of Management and Budget, said Monday that he expects states will eventually change their mind (Goldstein, 7/2).

The states’ responses won’t be clear for some time. But here are four scenarios to watch. 1) Red states opt out: The right to sit out the Medicaid expansion was one reason the 26 states went to court in the first place. … 2) Red states make noise, but then take the money: The White House is hoping that most, if not all, of the 26 states will see that big heap of federal Medicaid money on the table –– and take it. … 3) States will try to negotiate their terms for the expansion — particularly by trying to have more control over the program. …4) Red states put some in Medicaid, punt the rest to exchanges (Kenen and Feder, 7/3).

Politico Pro: States Choosing Not To Opt Out Of Expansion
The Supreme Court ruling put a spotlight on red states resisting Medicaid expansion, but some states are quietly moving ahead with plans to cover a lot more of their low-income population. Washington state Medicaid Director Doug Porter has been asked many times since Thursday if his state was rethinking the expansion (Smith, 7/3).

The Hill: Fifteen Governors Reject Or Leaning Against Expanded Medicaid Program
At least 15 governors have indicated they will not participate in the expansion of Medicaid under the healthcare law, striking a blow to President Obama’s promise of broader insurance coverage. Before Thursday’s Supreme Court ruling, states had the option of either increasing their Medicaid rolls or being penalized by the federal government. The high court struck down that offer as unconstitutional. Governors still have a financial incentive to participate in the expansion of coverage for low-income people, since the government will foot most of the bill through 2016 (Viebeck, 7/3)?

Des Moines Register: Branstad Is Firm On Opposing Idea To Grow Medicaid
Gov. Terry Branstad reaffirmed his resistance to expanding Medicaid on Monday, a stance that could reject $800 million annually in federal money to cover 150,000 poor Iowans without health insurance. The Republican governor has long raised doubts about President Barack Obama’s plan to expand Medicaid, which now generally doesn’t cover poor adults who lack minor children or serious disabilities (Leys and Clayworth, 7/2).

NewsHour: In Wake Of Health Reform Decision Medicaid Expansion In The Crosshairs
Under the law, Washington would pick up 100 percent of the cost of bringing about 17 million Americans into the Medicaid program. By 2020, that would drop to 90 percent, with the states picking up 10 percent indefinitely. Some states see that as a good deal, and for good reason, said Genevieve Kenney, a senior fellow at the Urban Institute. … But since the law was signed in 2010, state and local governments across the country have been going broke under the weight of the sour economy and dwindling tax revenues. … Even at 10 cents on the dollar, some of those states are saying they simply can’t afford a Medicaid expansion (Bowser, 7/2).

Medpage Today: After Court Decision, All Eyes On States
While the court found the Medicaid expansion is constitutional, it ruled that the provision in the law that gives the Secretary of Health and Human Services (HHS) the authority to financially penalize states that don’t comply with the expansion — by withholding federal Medicaid matching funds — is not constitutional. … For some states with very limited Medicaid programs, the 133% expansion could still come with significant costs, [one analyst] said. Not to mention that there is no guarantee that future congresses will continue to support the federal government footing most of the bill, he said (Walker, 7/2).

Modern Healthcare: GOP Tells Governors Not To Set Up Exchanges
GOP lawmakers in both chambers started their July 4 recess by asking the nation’s governors not to implement the state health insurance exchanges required under the Patient Protection and Affordable Care Act. Reps. Michele Bachmann (R-Minn.) and Jim Jordan (R-Ohio) along with Sen. Jim DeMint (R-S.C.) have sent a letter to all 50 governors that urged the state leaders to oppose creating state exchanges that the federal lawmakers say impose a financial threat to strained state economies (Zigmond, 7/2).

Minnesota Public Radio: Bachmann And Conservatives Ask Governors To Reject Exchanges
With the Supreme Court’s ruling last week to uphold the Affordable Care Act, conservative opponents of the law lost their main line of argument that the ACA was an unconstitutional expansion of government power. Now, with the help of Republican U.S. Michele Bachmann, they’re urging governors to slow the implementation of the law by refusing to create the online health insurance markets known as exchanges that are one of the ACA’s key policies. In a letter sent to all 50 governors, Bachmann and other tea party-linked members of Congress argue that “implementation of this law is not inevitable” (Neely, 7/2).

It is a Sad day in America when the Law of the Land is Ignored — yet again

It is a sad day for America when the law of the land is ignored, yet again.  Sonia Sotomayor was confirmed by the Senate to the Supreme Court today.

Sadly, ignoring our Constitution is happening all too often.  I was actually preparing to write this article, when I discovered that Jeannie had already done so and a lot better than I could.  So I am providing a snapshot of her page and a link to her post for you all to read and weep.  One of the  saddest things is that the msm made this confirmation about race when nothing could be further from the truth.  The Obama administration that should have been about healing race relations continues to work to divide on race issues.

Big news flash!  The Constitution unites us and protects us all if we will but submit ourselves to coming under the rule of law and insisting upon that from our leaders as well.

The one thing that I want to add to this post is a list of the votes on this matter and that will be added to the bottom of the post as soon as I find it or one of our readers provides it.  I will be adding the link and a list of all the names and how they voted because this vote will be a bellweather vote just like the Bush Bailout and the Obama Stimulus votes.

Please read Jeannie’s entire post and allow a tear to fall;  then get on your knees and pray because we need a mighty miracle of awakening and repentance in our land!  We need to both understand and appreciate and protect the Rule of Law.  Empathy?  Whose and when and for what purpose?

68 YEAS and 31 NOS

Fifty Nine Democrats +

Nine Republicans Vote For Sotomayor

Nine Republicans voted to confirm Sonia Sotomayor to the Supreme Court, giving her that 68-31 margin.

Here’s who they are: Lamar Alexander (TN), Kit Bond (MO), Susan Collins (ME), Lindsey Graham (SC), Judd Gregg (NH), Richard Lugar (IN), Mel Martinez (FL), Olympia Snowe (ME) and George Voinovich (OH).

All 31 other Republicans voted no. All 59 Democrats present voted yes, with Ted Kennedy missing the vote.

Congress is moving through bills and hearings at the speed of light. Focusing on one issue alone is a luxury we simply cannot afford.

Things are moving too fast, bills are too long, too many traditions and even rules are not being followed, and too many diversions are being created to either expect accurate projections can be made or statements relied upon as to when any particular bill will actually come up for a vote.

Following the wisdom of “those who fail to study history are doomed to repeat it”, we must learn that we should act as if these issues are imminent.

If you followed events closely leading up to the House of Represenatives’ vote on HR 2454 aka Cap & Trade, you likely noticed:

  • The prevailing wisdom of pundits, think tanks, and many on Capitol Hill was “Cap & Trade is in trouble”
  • Most people following issues in the Federal government and politics in general were focused on the outrageous actions of ABC News in regards to President Obama’s Health Care Town Hall when the announcement was made that Cap & Trade would be up for a vote on the House floor.
  • The House voted on HR 2454 late on a Friday afternoon, the slowest news day of the week.
  • The media opted to cover the death of pop star Michael Jackson rather than the passage of the Cap & Trade bill in the House.
  • Over 300 pages were added in the middle of the night and no complete copy was available at the time of the vote

There are several issues that require our attention NOW and going forward until they are DEFEATED (or passed).

  • Maintain pressure on US Senate and House representatives (contact them)
  • On particular issues, contact your Governor, State legislators, county, and city representatives.
  • Write a letter to the editor of your local newspaper

CONTACTING CONGRESS:

  1. Call the office for your Senator or House reps. where your representatives are currently, right now that is D.C., but verify it on the phone call
  2. Ask to speak directly with your Senator or Congressman
  3. Be sure to give your zip code so they know you are a constituent
  4. Be polite, but firm
  5. The next best method to a phone call is a fax, the least, email

WHY CONTACT YOUR STATE & LOCAL REPRESENTATIVES?

  • Several bills currently moving through Congress, if passed, seriously encroach on states’ rights, and in turn will put a lot of pressure on county and city governments.
  • It is essential that our state governments assert their sovereign rights
  • Although State legislatures are not currently in session this is the period during which legislators have the time to consider issues that need attention, or bills they will sponsor.

THE ISSUES & BILLS:

S. 909 Matthew Shepherd Hate Crimes Bill

Purpose: Increases penalties for certain crimes committed against certain people, particularly based on sexual orientation

Position: OPPOSE

Reasons:

  • Should not be snuck into a Defense spending bill
  • Endangers freedom of speech and religion
  • Presents problems with double jeapordy
  • Violates the equal protection clause of the Fourteenth Amendment by singling out certain groups of citizens to the exclusion of others

Status:

Included as an amendment to a Defense Spending Bill (S. 1390) late last week.

Nomination of Sonia Sotomayor to the United States Supreme Court

Position: Senate member should oppose her nomination, vocally.

Reasons:

Sotomayor has made public statements and issued rulings that indicate:

  • Lack of respect for the right to bear arms
  • Racial and gender bias
  • Lack of respect for property rights
  • Has indicated “empathy” is a higher priority than following the law

Further:

  • Made a statement that appellate court judges make law
  • Her testimony last week has troubling contradictions in contrast to her writings and the facts of her life.
  • During her testimony before the Senate Judiciary Committee, she showed a surprising lack of technical legal knowledge during some questioning, particularly in an interchange with Senator Hatch.
  • Has had a high rate of judicial error – 40%+ (her rulings were overturned)
  • Supports abortion through her statement that Roe v. Wade is settled law

Principles:

  • We should oppose those who are not clearly strict constructionists
  • Supporters of the Constitution in the Senate need to start showing themselves
  • Members of the Senate need to put the President on notice regarding this and future nominees to the Court

Status:

Conclusion of the hearings process, no clear date available regarding full Senate floor vote

“Health Care Reform” / Socialized Medicine

Several versions exist Was H.R. 676 now, H.R. 3200 (see summary article, linked)

Stated Purpose: To make affordable health care available to all

Position: OPPOSE

Reasons:

Puts government in charge of health care decisions

Will implement rationing, meaning government will ultimately decide who suffers or not, who lives or dies

Will kill private health insurance

Will drive talent and innovation out of the health care industry, leading to a reduced quality of care

Will kill small businesses, particularly if certain versions pass

Anyone who states this will not lead to a single payer only (government!) is outright lying. There is ample evidence that supporters want government to be totally in charge of health care.

Status:

Unclear at this time. There are mixed messages from the White House and Congress. The President seemed to be continuing to push Congress to pass as quickly as possible despite the recent CBO report. Again, since there has been much “ducking and weaving” that has occurred, we must not let up on our opposition.

The PASS Act H.R. 1291

Stated Purpose: To better protect the security, confidentiality, and integrity of personally identifiable information collected by States when issuing driver’s licenses and identification documents, and for other purposes.

Position: OPPOSE

Reasons:

  • This is yet another stealth bill, being “sold” as an improvement to “Real ID”, which has been very controversial
  • Passage of this bill means a NATIONAL Identity Card
  • Contains Biometric data like facial recognition technology
  • Real ID has always been sold as a way to “make us safer”
  • Many states have outright refused to comply, that is the reason for this latest maneuver, “to improve privacy”

Status: Currently in committee in the Senate; the next opportunity for revisions is July 29.

HR 2454 (2998) American Clean Energy and Security Act – Cap & Trade

Stated purpose: Reduce carbon emissions, achieve energy independence

Position: Oppose

Reasons:

Basic premise is entirely flawed, based on faulty / controversial science

Is about control, not “protecting the environment”

Violates the Tenth and Fourth Amendments in many respects through encroachment on states’ rights and required inspections

Will devastate America’s economy through regulations and taxes imposed on businesses, causing increased costs for energy

Will touch most aspects of our daily lives from the cars we drive to the appliances in our homes

Status:

Passed by the House of Representatives on June 26, 2009

Currently in the Senate Committee on the Environment and Public Works (EPW); Committee Chair Barb Boxer (D-CA) released a statement last week that this bill will not come up for a vote until after Congress’ August Recess

Defeat S. 909 Matthew Shepard Hate Crimes Bill

Status: Currently in the Senate, this bill could come up for a vote as early as TODAY.

As reported on the Boston.com site, this hate crimes legislation has now been attached to a Defense spending bill that is currently on the Senate floor.

There are many problems with “hate crimes” legislation, including that violates the equal protection clause of the Fourteenth Amendment by providing special protections to some citizens it does not afford to others. It further violates the First Amendment by suppressing speech and religion.

On the Truth Tellers site, there is a video featuring testimony of Attorney General Eric Holder admitting that the bill doesn’t provide equal protection for all.

Defeat Sotomayor for Supreme Court

Status: Currently in Senate Judiciary Com and will pass out of committee easily. This should be a target vote and we should ask all constitutionalists R’s and D’s and I’s to oppose this confirmation based on:

1) right to keep and bear arms

2) private property and the respect thereof

3) prolife core issue 4) ethical standing before the committee

5) judicial temperment
